Who is responsible if a driver hits a pedestrian who is crossing the street without following a traffic signal or using a crosswalk?

Pedestrians and vehicles both have responsibilities on the road, and the laws differ depending on the circumstances. That being said, if a pedestrian has entered any marked or unmarked crosswalk, drivers must stop and wait until the pedestrian has reached his or her destination — curb to curb. If it can be determined that the pedestrian entered the lane of traffic against traffic control signals, a pedestrian can be placed at fault for an accident.

California Vehicle Code Section 21950 also states that pedestrians must still use caution and cross safely. Pedestrians should not walk or run into the path of a vehicle, cause a road hazard, or unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.

¿Quién es responsable si un chofer atropella a un peatón que cruza la calle sin obedecer la señal de tráfico o no usa el crucero de peatones?

Ambos peatones y vehículos tienen responsabilidades en el camino y las leyes varían, dependiendo de la circunstancias. Habiendo dicho eso, si el peatón entra un crucero marcado o sin marcar, el chofer debe parar y esperar a que llegue al final — de banqueta a banqueta. Si se determina que el peatón entro al carril de trafico contra una señal de control de tráfico, puede culparse al peatón por el accidente.

Código Vehicular de California, Sección 21950, también dice que peatones aún tendrán que emplear precaución y cuidado al cruzar. Peatones no deberán caminar o correr en el carril en el cual corren vehículos, causar peligro en el camino, o parar o dilatar el tráfico sin necesidad mientras se encuentran en un crucero marcado o sin marcar.
